Ezy Access Solutions (“we”, “us”, or “our”) offers to sell its goods and services to the Buyer, subject to these Terms and Conditions of Sale, and to the exclusion of any other terms (whether express or implied, oral or written) unless otherwise agreed in writing by Ezy Access Solutions. By placing an order with us, you acknowledge your acceptance of these Terms and Conditions in full.

Definitions

In these Terms and Conditions, the following definitions apply:

  • Melbourne-based supplier of home accessibility and modification products.
  • “Buyer” or “Customer” means the individual, company, or entity purchasing goods or services from Ezy Access Solutions.
  • “Goods” means any products, including accessibility ramps, grab rails, bathroom safety equipment, assistive devices, or any other items offered for sale by Ezy Access Solutions.
  • “Custom Goods” means any goods manufactured or modified to the Buyer’s specific requirements.
  • “Order” means any purchase order, quote acceptance, or request to supply Goods placed by the Buyer.
  • “Website” means the Ezy Access Solutions website and any associated online sales platform.

1. Quotes and Orders

1.1  Ezy Access Solutions reserves the right to accept or refuse any order at its absolute discretion without providing a reason.

1.2  All quotes and orders are confirmed in writing via documents, emails, or online order confirmations provided to the Buyer.

1.3  The Buyer must review all order details carefully upon receipt and notify Ezy Access Solutions immediately of any errors or discrepancies. Ezy Access Solutions will not be responsible for errors not reported within 24 hours of receiving confirmation.

1.4  Any costs, losses, or delays arising from the Buyer’s failure to provide accurate information, or from errors made by the Buyer, are the sole responsibility of the Buyer.

1.5  Cancellations or amendments to orders may incur fees at Ezy Access Solutions’ discretion, particularly where production or procurement has already commenced. Custom Goods cannot be cancelled once manufacturing has begun.

1.6  Ezy Access Solutions reserves the right to amend prices, descriptions, or product specifications on its website without prior notice.

2. Pricing

2.1  All sales are invoiced at the price quoted at the time of the order, or at the prevailing price listed on the website at the time of purchase, whichever is applicable.

2.2  Quoted prices are valid for the period specified in the quote, typically 30 days from the date of issuance, unless otherwise stated.

2.3  Product prices displayed on the website do not include delivery charges unless explicitly stated. Delivery charges will be confirmed at checkout or upon invoicing.

2.4  Ezy Access Solutions reserves the right to correct any pricing errors on the website. If an order is placed at an incorrect price, we will notify the Buyer and offer the option to proceed at the correct price or cancel the order for a full refund.

2.5  Each consignment is treated as a separate transaction and will be invoiced independently.

3. Payment

3.1  Payment for online orders is due at the time of purchase unless a credit account has been approved in writing by Ezy Access Solutions.

3.2  Approved credit accounts must be settled by the invoice due date as specified on the invoice.

3.3  Ezy Access Solutions reserves the right to deny, suspend, or revoke credit at its sole discretion without notice.

3.4  Overdue accounts may incur interest at the Reserve Bank of Australia cash rate plus 8% per annum, calculated daily on the outstanding amount.

3.5  The same interest rate applies to amounts that exceed an approved credit limit.

3.6  Ezy Access Solutions may withhold the dispatch of Goods where a Buyer’s account is overdue, over the credit limit, or subject to a payment dispute.

3.7  All amounts are in Australian Dollars (AUD). Ezy Access Solutions is not responsible for currency conversion fees charged by third-party financial institutions.

4. Deliverys

4.1  Ezy Access Solutions will use reasonable endeavours to dispatch Goods within the estimated timeframe provided. Delivery timeframes are estimates only and are not guaranteed.

4.2  Ezy Access Solutions’ delivery responsibility ceases at the nominated delivery address frontage. Buyers are responsible for ensuring safe and adequate access to the delivery point.

4.3  Delivery drivers may, at their discretion, decline to carry Goods beyond the public street frontage or loading dock of the delivery address.

4.4  Deliveries are made using Ezy Access Solutions’ nominated courier or freight partner. Alternative delivery arrangements must be approved in writing in advance.

4.5  Ezy Access Solutions accepts no liability for delays caused by the courier, third-party logistics providers, weather, natural disasters, or other circumstances beyond our control.

4.6  Risk of loss or damage to the Goods passes to the Buyer upon delivery to the nominated delivery address.

4.7  Where a delivery is unsuccessful due to the Buyer’s absence or failure to provide adequate access, any re-delivery fees will be charged to the Buyer.

5. Returns and Claims

5.1  The Buyer is responsible for confirming that the product specifications, dimensions, and suitability meet their requirements before placing an order. Ezy Access Solutions strongly recommends seeking advice from a qualified Occupational Therapist (OT) or building professional where required.

5.2  To the extent permitted by law, Ezy Access Solutions disclaims all warranties, conditions, or representations not expressly set out in these Terms and Conditions.

5.3  Claims for faulty or incorrectly supplied Goods must be made within 30 days of delivery. Claims will not be accepted for Goods that have been installed, modified, or incorporated into another structure.

5.4  Returns of non-faulty Goods may be accepted within 30 days of delivery by prior written agreement, provided the Goods are in original, resaleable condition with original packaging. A restocking fee may apply.

5.5  All returns are subject to visual inspection by Ezy Access Solutions. Goods that show signs of use, damage, or modification will not be accepted for return.

5.6  Freight and handling costs for returns are the responsibility of the Buyer unless the return is due to an error by Ezy Access Solutions.

5.7  Refunds will be processed in accordance with Ezy Access Solutions’ Refunds Policy, available on our website.

5.8  Claims for missing items from a delivery will not be accepted unless the Buyer obtained and retained a delivery receipt at the time of delivery.

5.9  Delivery of Goods constitutes acceptance. Any claims arising after delivery should be submitted to our team in writing via email.

6. Custom and Made-to-Order Goods

6.1  Goods that are manufactured, cut, shaped, or otherwise modified to Buyer-specified dimensions or requirements are considered Custom Goods.

6.2  Custom Goods are non-returnable and non-refundable unless they are found to be defective, incorrectly manufactured, or do not conform to the agreed specifications.

6.3  The Buyer is responsible for providing accurate measurements and specifications for all Custom Goods. Ezy Access Solutions accepts no liability for Custom Goods that fail to fit or function as intended due to inaccurate information provided by the Buyer.

6.4  Production of Custom Goods will not commence until payment or deposit has been received. Lead times will be communicated at the time of ordering and are estimates only.

7. Title and Risks

7.1  Title (ownership) of Goods does not pass to the Buyer until payment in full has been received by Ezy Access Solutions for all outstanding amounts.

7.2  Until title passes, the Buyer holds the Goods as fiduciary agent and bailee of Ezy Access Solutions and must store the Goods separately and clearly identified as the property of Ezy Access Solutions.

7.3  Risk of loss, damage, or deterioration of the Goods passes to the Buyer upon delivery to the nominated delivery address, regardless of whether title has passed.

7.4  Ezy Access Solutions reserves the right to repossess Goods where full payment has not been received, and the Buyer consents to Ezy Access Solutions entering any premises where such Goods are stored for the purpose of repossession.

8. Australian Consumer Law

8.1  Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights or remedies the Buyer may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation.

8.2  Where any implied guarantee or warranty cannot be excluded by law, Ezy Access Solutions’ liability is limited to the extent permitted, which may include (at our option): replacement or repair of the Goods, or refund of the purchase price.

9. GST and Taxes

9.1  All prices displayed on the Ezy Access Solutions website are inclusive of Goods and Services Tax (GST) at the applicable rate, unless otherwise stated.

9.2  If any new government tax, duty, or levy is introduced or changed after an order is placed and prior to delivery, Ezy Access Solutions reserves the right to pass on any increase to the Buyer.

9.3  Tax invoices will be issued for all purchases and will display GST amounts separately where required.

10. Limitation of Liability

10.1  To the maximum extent permitted by law, Ezy Access Solutions will not be liable for any indirect, consequential, special, or incidental loss, damage, or expense arising from or connected to the supply of Goods or services, including loss of profit, loss of business opportunity, or personal injury

10.2  Ezy Access Solutions’ total liability for any claim arising from the supply of Goods shall not exceed the purchase price paid for the relevant Goods.

10.3  The Buyer acknowledges that accessibility and safety products must be installed by qualified tradespeople in compliance with applicable Australian Standards and building codes. Ezy Access Solutions accepts no liability for incorrect installation.

11. Force Majeure

11.1  Ezy Access Solutions will not be held liable for any failure or delay in performing its obligations under these Terms and Conditions where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, floods, fire, or extreme weather
  • Pandemic, epidemic, or public health emergency
  • Acts of war, terrorism, or civil unrest
  • Changes in applicable law or government regulation
  • Industrial disputes or supply chain disruptions
  • Failure of third-party logistics or courier services

11.2  In such circumstances, Ezy Access Solutions will use reasonable endeavours to notify the Buyer and resume supply as soon as practicable.

12. Colour Variations

12.1  Ezy Access Solutions will endeavour to supply Goods in the colour specified by the Buyer. However, due to variations in manufacturing batches, material stock, and monitor display settings, minor colour variations may occur.

12.2  Colour samples shown on the website or in printed materials are indicative only and may not precisely match the final product. Such variations do not constitute grounds for rejection or return of Goods.

 

13. Intellectual Property

13.1  All content on the Ezy Access Solutions website, including text, images, product descriptions, logos, and trademarks, is the intellectual property of Ezy Access Solutions or its licensors and is protected by applicable Australian and international laws.

13.2  The Buyer must not reproduce, copy, modify, distribute, or use any content from the Ezy Access Solutions website without prior written consent.

14. Privacy

14.1  Ezy Access Solutions collects, uses, and stores personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

14.2  Personal information collected during the purchase process will only be used to process orders, communicate with the Buyer, and improve our services. It will not be sold to third parties.

15. Amendments to Terms

Ezy Access Solutions reserves the right to amend these Terms and Conditions at any time without prior notice. The most current version will always be available on our website. Continued use of our website or placement of an order constitutes acceptance of the current Terms and Conditions

16. Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes arising from these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of Victoria
